Terms and Conditions
Effective Date: 17 June 2025
Applies to: All participants, attendees, parents/guardians, staff, and visitors involved in Whai Community events, leagues, camps, and programmes.
1. General Participation Terms
By registering for or attending any Whai Community activity, you agree to the following terms:
Assumption of Risk: Participation in basketball and related activities carries inherent risks. By participating, you acknowledge and accept these risks.
Medical Care: You authorise Whai staff to seek medical attention in case of emergency. All injuries or illnesses must be reported to Whai staff immediately.
Code of Conduct: Participants must behave respectfully towards staff, volunteers, fellow participants, and property. Whai reserves the right to remove individuals who do not meet behaviour expectations.
Photography & Media: By participating, you grant Whai the right to use photos, videos, and recordings of you (or your child) for promotional and archival purposes unless you opt out in writing prior to the event.
Refunds: Refunds are not guaranteed and will be assessed on a case-by-case basis for cancellations due to injury or exceptional circumstances.
Parent/Guardian Responsibility: For participants under 18, parents/guardians must ensure prompt drop-off and pick-up. Children remain under the guardianship of Whai staff only during scheduled programme times.
2. Facility Use at 105 Birch Avenue
Whai operates its facility under Resource Consent. As part of our consent obligations, all users of our programmes must comply with the following:
a. Attendance Capacity
The building may not exceed 300 people at any time, including players, staff, and spectators.
Event organisers must ensure attendee numbers remain within this limit.
b. Parking and Transport
To reduce neighbourhood impact:
On weekdays between 6am–4pm, only the carparks directly adjoining the Birch Avenue site may be used. No on-street parking is permitted by staff, attendees, or visitors.
Four onsite parking spaces are reserved for staff, with signage indicating this use.
All users must follow instructions communicated via email or signage regarding parking areas and alternative transport options.
A Car Parking Management Plan (CPMP) is in place to guide this; by attending, you agree to comply with its terms.
c. No Complaints Covenant
By registering or attending a Whai event at 105 Birch Avenue, you acknowledge:
This facility operates in an industrial zone, and you agree not to lodge complaints with local authorities regarding existing, lawfully operating industrial activities in the area.
This is a term of entry and participation and supports our commitment to long-term operations at the site.
3. Logbook and Event Recording
To ensure compliance, Whai maintains a logbook of all events, including attendance counts. This log is available to Tauranga City Council upon request.
4. Emergency and Flood Safety
A Flood Safety and Evacuation Plan is maintained on-site.
All users must follow evacuation instructions if required. This is particularly important for vulnerable individuals (e.g. children, elderly, disabled).
5. Agreement
By participating in any Whai Community event or programme, or by entering our Birch Avenue facility, you confirm that you:
Have read, understood, and agreed to these Terms and Conditions.
Will comply with the rules outlined, including those required by Tauranga City Council under Resource Consent.
Accept that Whai Basketball reserves the right to modify or update these Terms at any time, with notice posted on this page.
